Ordinance No. 2099

AN ORDINANCE TO WAIVE COMPETITIVE BIDDING TO PURCHASE A CASE MODEL 580 SUPER M SERIES 3 BACKHOE FOR THE EUREKA SPRINGS, AR, PUBLIC WORKS DEPARTMENT

WHEREAS, the City of Eureka Springs, AR, (“the City”) is currently in need of a backhoe partially due to the recent damage caused by this winter’s ice storm; and,

WHEREAS, the Public Works Director has researched the cost and availability of acquiring said equipment.

NOW THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS:

Section 1. That the City Council of Eureka Springs, AR, does hereby waive the competitive bidding requirements of the Arkansas Code Annotated and the Eureka Springs Municipal Code to allow for the contracting by the City of Eureka Springs with the Kansas State Bank of Manhattan for the lease with option to purchase of a Case Model 580 Super M Series 3 Backhoe as contracted by the Public Works Director.

Emergency Clause

Section 2. That due to the immediate need to deal with the storm debris within the City, for the health and safety of the citizens of the City; an emergency is hereby declared to exist and this ordinance shall take effect upon its passage by the Eureka Springs City Council and signing by the Eureka Springs Mayor.
