ORDINANCE NO.  2110

AN ORDINANCE AMENDING SECTION 4.36.01 OF CHAPTER 4.36, OCCUPATIONAL LICENSES, OF THE EUREKA SPRINGS MUNICIPAL CODE.

FOR THE CITY OF EUREKA SPRINGS, ARKANSAS:

WHEREAS, the City Council of the City of Eureka Springs has determined that it is in the best interests of the City of Eureka Springs to require the designation of a local agent whenever an occupational license is procured.

NOW THEREFORE, be it hereby ordained by the City Council of the City of Eureka Springs, Arkansas, that Chapter 4.36, Occupational Licenses, of the Eureka Springs Municipal Code be amended as follows:

Section 1: That Section 4.36.01(A) of the Eureka Springs Municipal Code is hereby amended by adding:

Any person, firm, partnership, company or corporation requesting an occupation license hereunder shall (1) certify the name, address and telephone number of an agent who resides in Arkansas and is qualified to accept notices and service of process on behalf of the holder of the occupation license and (2) shall keep such information current.

Section 2:  All Ordinances or Resolutions, and parts thereof, in conflict with this Ordinance are hereby repealed to the extent of such conflict. In the event any one or more of the provision contained in this Ordinance shall for any reason be held by a Court of competent jurisdiction to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect the remaining provisions of this Ordinance, and this Ordinance shall be construed as if such invalid, illegal or unenforceable provision or provisions had never been contained herein.
