ORDINANCE NO. 2127
AN ORDINANCE CALLING FOR AN ELECTION TO REFER THE ISSUE ALLOWING A ONE TIME BOW AND ARROW DEER HUNT REGULATED BY THE ARKANSAS GAME AND FISH COMMISSION TO THE VOTERS OF THE CITY OF EUREKA SPRINGS, ARKANSAS; DECLARING AN EMERGENCY TO EXIST; AND FOR OTHER PURPOSES.

WHEREAS, The City Council of the City of Eureka Springs, Arkansas, has made a comprehensive study and review of possible over population by deer within the City and its effects on the City and its citizens; and,

WHEREAS, in the opinion of the City Council, that the citizens’ will should be heard on this issue;

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS, THAT:

Section 1. That the County Board of Election Commissioners is hereby notified as required by Arkansas code Annotated that ordinance 2127 has been passed directing that the issue of allowing a one time bow and arrow deer hunt within the corporate city limits of Eureka Springs, Arkansas, be referred to the voters of the City of Eureka Springs at the next General Election.

Section 2. That said bow and arrow hunt would be according to regulations promulgated and times set by the Arkansas Game and Fish Commission within the areas proscribed by the Arkansas Game and Fish Commission, in their constitutional authority to regulate the dame and fish population anywhere in the State of Arkansas.

Section 3. That attached hereunto is the Ballot Title to be used.

Section 4. Repeal Clause: All Ordinances, Resolutions, and parts thereof, in conflict herewith are hereby repealed to the extent of such conflict.

Section 5. Emergency Clause: Since it is necessary to quickly address issues of possible overpopulation by deer within the City for the preservation of public peace, health and safety, an emergency is hereby declared to exist and this ordinance shall take effect and be in force from and after its passage and approval.

PASSED AND ORDAINED BY THE CITY COUNCIL FOR THE CITY OF EUREKA SPRINGS, ARKANSAS, ON THIS  23 DAY OF  AUGUST, 2010.
