BREAKING NEWS:

ORDINANCE NO. 2097

AN ORDINANCE WAIVING THE PAYMENT OF THE TREE CUT PERMIT FEE FOR APPLICATIONS APPLIED FOR FROM FEBRUARY 10, 2009, THROUGH MARCH 31, 2009.

WHEREAS, a large number of trees within the city limits of Eureka Springs, Arkansas, were broken and severely damaged by the ice storm January 26 and 27, 2009.
WHEREAS, the City Council of the City of Eureka Springs, Arkansas, in an effort to encourage citizens to clear destroyed/damaged standing trees desires to waive the permit fee to remove trees as established by Eureka Springs Municipal Code 7.56.02(B).

NOW, THEREFORE, BE ITORDAINED BY THE CITY COUNCIL OF EUREKA SPRINGS, ARKANSAS, THAT:

Section 1. The requirement of the $20 fee for the permit set out in Municipal Code 7.56.02(B) to remove trees that are damaged or potentially dangerous to property as a result of the January 26 and 27, 2009, ice storm be waived from February 10, 2009, to March 31, 2009.
Section 2. The duration of the tree removal permit as set out in Municipal Code 7.56.02(B) be changed from one (1) year to ninety (90) days for the purpose of this ordinance only.
Section 3. All other requirements of Municipal Code 7.56, as amended, shall still be in effect.
Section 4. Emergency Clause: An emergency is hereby declared to exist; and it is necessary for the preservation of public peace, health, and safety and continuance of public services, this ordinance shall take effect and be in force from and after its passage and approval.

PASSED AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS, ON THIS 9TH DAY OF FEBRUARY, 2009.
