ORDINANCE NO. 2125

AN ORDINANCE AMENDING TITLE 14 SECTION 14.08.13 DEFINITIONS OF THE EUREKA SPRINGS, ARKANSAS, MUNICIPAL CODE

WHEREAS, the City Council of the City of Eureka Springs, Arkansas, believes it to be in the best interest of the City to occasionally make amendments to the Municipal Code of the City of Eureka Springs, Arkansas, to keep abreast of changing technologies;

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS, THAT:

Section 1. That Title 14 Zoning Chapter 14.08.13 Definitions of the Municipal Code of the City of Eureka Springs, Arkansas, is hereby amended.

Section 2: That in the definition of “Structure or building” the words “wind generating device” will be added after the first use of the word “building.”

Section 3. That provisions of this ordinance are hereby declared to be separable and if any provision shall for any reason be held illegal or invalid, such holding shall not affect the validity of the remainder of this ordinance.

Section 4. All ordinances and resolutions or parts thereof, in conflict herewith are hereby repealed to the extent of such conflict.
