COUNCIL MEETING MINUTES
June
25, 1996
Mayor Barbara O’Harris
called the regularly scheduled meeting to order at 9 a. m. on Tuesday, June
25th, 1996, in the Western District Courthouse.
PRESENT:
Mayor O’Harris, Aldermen
David Jeffrey, Chris Riker, and Bill Rubley;
Alderwomen Jan Watson,
Kim Dickens, and Sheila Seratt.
ALSO PRESENT: Kirby
Murray, Don Matt, Mike Ellis, James DeVito, Sharon Hamm, Jay Miner, Don Young
and Clerk Lee.
PLEDGE OF ALLEGIANCE:
Mr. Young led in the
Pledge of Allegiance.
Mayor O’Harris led the
Council in welcoming the new Councilwoman Kimberly Dickens. She said they
appreciated Kim’s desire to serve the community.
APPROVAL OF THE AGENDA:
Alderwoman Seratt made
the motion to approve the agenda. Alderwoman
Watson seconded. All
were in favor, 6/0/0.
APPROVAL OF THE MINUTES:
Alderwoman Seratt made
the motion to approve the minutes of June 11,
1996. Alderman Jeffrey
seconded.
Alderman Jeffrey pointed
out that on page two, the vote on the approval
of the minutes for May
28th was not recorded. Also, on page 5,
Alderwoman Seratt
withdrew her second, not Alderman Riker.
Alderman Jeffrey made
the motion to amend the minutes. Alderwoman
Seratt seconded. All
were in favor, 6/0/0.
The vote to approve the
minutes as amended was unanimous, 6/0/0.
OLD BUSINESS:
1. Proposed Ordinance
#1699, Water Fee Turn off/on, Third reading. Alderwoman Seratt made the motion
to place Ordinance #1699 on its third and final reading by title only.
Alderwoman Watson seconded. All were in favor, 6/0/0.
Mr. Young read the
ordinance by title only.
Alderman Rubley made the
motion to approve. Alderwoman Seratt seconded. The ordinance was passed on its
third reading, 6/0/0.
2. Ordinance # 1707,
Amending Chapter 8.16, Parking Code, second reading:
The Council pointed out
that the Ordinance was due for its third reading. Alderwoman Seratt made the
motion to place Ordinance #1707 on its third and final reading by title only.
Alderwoman Watson seconded. All were in favor, 6/0/0.
Alderwoman Watson made
the motion to approve. Alderwoman Seratt seconded. The ordinance passed on its
third reading, 6/0/0.
3. Ordinance #1708,
Large Vehicle Ordinance, Tourism Advisory Committee, 2nd reading:
Alderwoman Seratt made
the motion to place Ordinance #1708 on its second reading by title only.
Alderwoman Dickens seconded. All were in favor, 6/0/0.
Mr. Young read the
ordinance by title only.
Alderwoman Seratt made
the motion to approve. Alderwoman Dickens seconded.
Mr. Miner said he is
basicly pleased with the ordinance but there are a few minor changes in the
wording he would like to discuss with Bill Douglass.
He said he thought it
could be ironed out by the end of the week and the ordinance would then be
ready for the third reading by July 9, 1996.
He explained that he had reservations about a large truck or bus having
to come downtown to pick up a permit to travel to a destination on the loop.

He said he had worked
as an attorney for a large trucking firm at one time, and that it bothered him
because he didn’t want the City to add a burden to interstate commerce. Also,
he would like to make sure that the ordinance would withstand any challenge.
The vote on the
second reading was in favor, 6/0/0.
4. Ordinance #1709,
Group Tour Franchise, Tourism Advisory Committee, second reading:
Alderwoman Seratt
made the motion to place Ordinance #1709 on its second reading by title only.
Alderwoman Watson seconded. All were in favor, 6/0/0.
Mr. Young read the ordinance
by title only.
Alderwoman Watson
made the motion to approve. Alderwoman Seratt seconded.
Mr. Miner said that
he had the same comments for this ordinance. He said that it was basically well
written, and he had just a few things he wanted to go over with Mr. Douglass.
Alderman Rubley said
that under 4.54.10 he thought that the City should set the fees and decide how
the relationship between private enterprise and the City should be funded. Mr.
Miner said that was one of the areas he would like to discuss.
Mayor O’Harris stated
for the record that Ordinances #1708 and #1709 would be worked on, discussed at
the July 2nd meeting, and read in their entirety before they would be voted on
for the third time.
The ordinance passed
on its second reading, 6/0/0.
5. Condemned
Buildings, Mr. Hawkins:
Mr. Hawkins was not
able to be present. Mr. Miner will take care of item
#5 on the agenda.
NEW BUSINESS:
1. Award
of bid for Fuel Supplier, Mr. Young:
Mr. Young said that Ozark Country
Market sent in a bid of a 3% discount on gasoline prices. The owner is Lynn
Dickey. He has Phillips 66 which is a premium product. He said that his price
has always been about 2 cents a gallon cheaper because of the lack of some of
the conveniences of a larger station. That means a five cents per gallon
discount. He said that billing will follow the same procedure but with a larger
discount and that the home office will deduct the federal taxes before the
billing is sent out. Alderman Rubley made the motion to approve that bid.
Alderwoman Watson seconded. The vote to approve was 6/0/0.
DEPARTMENT REPORTS:
Alderwoman Seratt reported that work
is progressing well at 46 Van
Buren.
Alderman Jeffrey said that the City
will be opening bids for the Public Works Building today at 2 p.m.
Mayor O’Harris mentioned that
Position #2 is open on the Auditorium
Commission since Alderwoman Dickens
resigned. Mayor OHarris said the
Commission had some ideas and she
would present them to the Council at
the July 2,1996 meeting.

Mayor OHarris
announced the C.A.P.C. meeting will be Thursday, June 27 at 7 p.m.
Mayor O’Harris spoke
about Lamont Richie, who is the Chairman of the Planning Commission. She said
he has done a wonderful job and that he had agreed to continue for another
three year term. She asked the Council to approve him for three more years, and
they did so unanimously, 6/0/0.
She reminded everyone
of the Special Council Meeting, June 27,1996 at 9
a.m. She also
reminded everyone of the Public Hearing on the 911 System before the
agenda-setting meeting on July 2nd at 7 p.m.
Alderwoman Seratt
made the motion to adjourn. Alderman Riker seconded. All were in favor, and the
meeting was adjourned at 9:27 a.m.
