CITY COUNCIL MEETING MINUTES

OCTOBER 22, 1996

 

Mayor Barbara OHarris called the regularly scheduled meeting to order at

9:27 a. m. on Tuesday, October 22, 1996, in the Western District

Courthouse.

The meeting followed a Public Hearing at 8:30 a.m. for Transit, and a

Public Hearing at 9:05 a.m. on a petition to vacate.

 

PRESENT:

Mayor Barbara A. O’Harris; Aldermen David Jeffrey, Chris Riker, and Bill

Rubley; and Alderwomen Sheila Seratt, Kim Dickens and Jan Watson.

 

ALSO PRESENT:

Don Matt, David McNeaI, Earl Hyatt, Willis E. Schenck , Jay Miner, Don

Young, and Clerk Lee. If there were any others, they didn’t sign in.

 

PLEDGE OF ALLEGIANCE:

Mr. Young led us in the Pledge of Allegiance.

 

APPROVAL OF THE AGENDA:

Alderman Rubley made the motion to approve the agenda. Alderwoman

Seratt seconded. All were in favor, 6/0/0.

 

APPROVAL OF THE MINUTES:

Alderwoman Watson made the motion to postpone approving the minutes to the November 12th meeting. Alderwoman Seratt seconded. All were in favor, 6/0/0. The Clerk forgot to put the minutes in the Council’s boxes.

 

OLD BUSINESS:

1.      Establish a No Parking Zone at 14 Washington St., Ordinance #1735:

Alderman Rubley made the motion to place Ordinance #1735 on its second reading by title only. Alderwoman Watson seconded. All were in favor, 6/0/0.

Mr. Young read the ordinance by title only.

Alderwoman Dickens made the motion to approve. Alderwoman Watson seconded. All were in favor, by roll call, 6/0/0.

 

Alderwoman Watson made the motion to suspend the rules and place Ordinance #1735~on its third and final reading by title only. Alderwoman Seralt seconded. By roll call, the vote was 6/0/0. Mr. Young read the ordinance by title only.

Alderwoman Watson made the motion to approve. Alderwoman Dickens seconded.

Alderman Rubley and Alderman Riker said they saw no reason to push this through. Alderman Jeffrey said it has been two weeks and there doesn’t seem to be a problem.

By roll, the vote was 6/0/0, and the ordinance passed on its third reading.

 

2.      Ordinance #1714, (911), Mr. Miner (First Reading):

Alderman Riker made the motion to place Ordinance #1714 on its first reading, in its entirety. Alderwoman Seratt seconded. All were in favor, 6/0/0.

Mr. Young read the ordinance in its entirety.

Alderwoman Seratt made the motion to approve. Alderwoman Dickens seconded.

Alderman Rubley said that he understood that all of the Van Buren Streets were going to be changed to Highway 62. On the top of page three, there was a typo. He said he did not want to vote more than once on this today. By roll call, the vote was 6/0/0, and the first reading was passed.

 

At this time the Mayor said that there were two things to be added to the agenda, that had been left off.  One was the opening of the trolley bids.  The other was the first reading of Ordinance #1735,  vacating a portion of First Street.

Alderman Jeffrey made the motion to amend the agenda to add the two items.  Alderwoman Dickens seconded.  All were in favor, 6/0/0.

3.     Ordinance #1734, Police Undercover Fund, Chief Hyatt (third reading):

Alderman Rubley made the motion to place Ordinance #1734 on its third and final reading by title only. Alderwoman Seratt seconded. All were in favor, 6/0/0.

Mr. Young read the ordinance by title only.

Alderman Rubley made the motion to approve. Alderwoman Seratt seconded. By roll call, the vote was 6/0/0, and the ordinance passed on its third reading.

 

NEW BUSINESS:

1 Permission for the Parade Permit fee to be waived for the Holiday Promotion Committee for November 8, 1996 and December 21, 1996, for the annual Jingle Bell Walk, Mary Christians:

Alderman Jeffrey suggested that one Walk go down Benton St. and the later Walk go down Spring Street so that everyone will have a chance to enjoy it. Mrs. Christians said that at the time of the early walk, those people on White Street and Prospect, etc., have their house decorated and lighted and that’s why they did the walk down Benton last year. She said that she would alter the route for the December 21st walk to come down Spring St. Alderman Rubley made the motion to approve the waiving of fees. Alderwoman Dickens seconded. All were in favor, 6/0/0.

 

2.     Waive the fee for the Third Annual Christmas Parade, George

Christman:

The Christmas Parade will be held on Sunday, November 17th.. The Parade will assemble at the Crescent Hot& at 5 p.m., and leave at 6 p.m. It will go down Ellis Grade to Spring St. and along the Historic Downtown area. Alderwoman Seratt made the motion to approve. Alderwoman Dickens seconded.

In discussion, Alderman Rubley said that he would like to see a City endorsed. Parade automaticly be done. He said that perhaps the ordinance should be amended so that people dont have to take time from their busy days to come and the Council doesn't have to take the time to okay them.

 

Mr. Miner suggested that the requests be dropped off at the Mayor's office, and that she could waive them, with proper documentation.

 

All, were in favor to waive the parade fee, 6/0/0.

 

Mayor announced the forming of the Bucket Brigade, which is the auxiliary organization for the Fire Department. She said that so far, most of the people who are active are the members of the Department and their families. She asked that people get involved to help to fill the needs of our Fire Department. She said the anyone who benefits from the protection our Fire Department provides should join. The membership is $5.00 per year. She said the applications can be picked up at City Hall, the Fire Department, the Bank of Eureka Springs, and First Eureka Springs Bank. The House of Horrors will be held on Friday, October 25th and Saturday, October 26th from 7 p.m. to 9 p.m. She asked for the support of the community in heIping to raise money for equipment that departments in other areas take for granted. The first piece of equipment that the department wUl buy is a heat sensor to detect fire in the walls. It is a safety measure but also there is less destruction to the structure when they know where the fire is in a wall.

 

Alderwoman Seratt announced that Wor!d Aids Day is December 1, 1996. She said that there will be a candlelight vigil in Basin Park that night and lights will be turned off for one minute all over the world. She doesn't know the exact time but will legt us know later.  She would like to see a Proclamation adopted by City and published.

The Council asked for a 5 minute recess, which began at.9:58 and the meeting was reconvened at 10:05 a.m. Alderman Jeffrey had to leave.

 

3. Opening of Trolley Bids:

Mr. Fargo gave the bid to the Mayor for the new trolley.

The base bid was $206,380. The options that must be added are the wheelchair lift, at $22,500, the public address system, at $725 and the spare tire, and wheel, at $475, for a total of $230,080.

Mr. Fargo said that the state will pay $200,000, which would leave the City with~the price of $30,080. The delivery date, if this bid is accepted, is fall of 1997. Mr. Fargo said the State might pay a bit more but they

•have already said that they will pay up to $200,000. Alderman Rubley asked if the State is really committed. Mr. Fargo said that he has a letter that says they are committed. He said he sent bid specifications to the companies who build these. They published the advertisement for bids, also. One company bid, and that is Chance in Wichita.

Alderwoman Watson made the motion to accept this bid. Alderwoman Seratt seconded.

Alderman Rubley said that he remembered that a vehicle would be retired, but not disposed of when Mr. Fargo got the new trolley. Mr. Fargo said that is true. Number One trolley and Number Five trolley have been released by the State. The City has to build a reserve of trolleys, and these trolleys are going to be part of the reserve.

Alderman Rubley asked if our storage area is adequate. Mr. Fargo is sure that he can house everything but the two old trailers from the two trams we have now. Eventually, we will need more storage. He said he thinks that there will be room for the new trams which will be delivered in late November. He said, that the propane tank is in place, and the chain link fence has been built and the slab.

The vote to approve, by roll call, was 5/0/0.

4. Petition to vacate, Mr. Smith and Mr. Wilson, Ordinance #1733, first reading:

Alderwoman Seratt made the motion to place Ordinance #1733 on its first reading in its entirety. Alderman Rubley seconded. All were in favor, 5/0/0.

Mr. Young read the ordinance in its entirety.

Alderwoman Watson made the motion to approve. Alderwoman Seratt seconded. With little discussion, the vote was 4/1/0, with Mr. Riker voting no. The ordinance passed on its first reading.

 

ADMINISTRATIVE ASSISTANT’S REPORT:

COMMISSIONS:

1. Auditorium: Vacancy on Position 5.

6. Parking Authority: Vacancy on Position 2.

 

ANNOUNCEMENTS:

The Mayor reminded the Citizens of Candidate’s Night, Wednesday, October 23, 1996, at 7 p.m. Mr. Miner said that each Candidate will give a two minute presentation. Then each Candidate will be asked questions, of which they already have read. At nine p.m. the meeting will be over and the Candidates will be able to talk to the voters who are present.

 

Alderwoman Watson made the motion to adjourn. Alderwoman Seratt seconded. All were in favor. The meeting was adjourned at 10:20 a.m.
