COUNCIL MEETING MINUTES

NOVEMBER 26, 1996

 

Mayor O’Harris was absent for the first part of (lie meeting. Alderwoman

Seratt made the motion that Alderman Jeffrey be Mayor Pro-Tern until the

Mayor arrives. Alderwoman Watson seconded. All were in favor, 4/1/0,

except Mr. Jeffrey, who said a smiling no.

The regularly scheduled City Council Meeting was called to order by Mayor

Pro Tern Jeffrey at 9:01 a.m. on November 26, 1996.

 

PRESENT:

Mayor Pro Tem Jeffrey, Alderman Rubley, and Alderwomen Dickens, Seratt, and Watson. Alderman Riker was absent.

 

ALSO PRESENT:

Alan Epley, Bill Wilson, Charles Fargo, David McNeal, Earl Hyatt, Don Matt, Don Young, Jay Miner, and Clerk Lee.

 

PLEDGE OF ALLEGIANCE:

Don Young led in the Pledge of Allegiance.

 

APPROVAL OF THE AGENDA:

The Council decided to move #1, New Business, Ordinance #1739,

recinding Ordinance #1732 to #1, Old Business and then go down the line.

Alderman Rubley made the motion to approve as amended. Alderwoman

Watson seconded. All were in favor, 5/0/0.

 

APPROVAL OF THE MINUTES:

The Council Members hadn’t all had time to read the minutes of November 12, 1996. Alderman Rubley made the motion to postpone the approval of the minutes until the December 10th Council Meeting. Alderwoman Seratt seconded. All were in favor, 5/0/0.

 

OLD BUSINESS:

1.     Ordinance #1739, Rescinding Ordinance # 1732:

Alderwoman Watson made the motion to place Ordinance #1732 on its first reading in its entirety. Alderwoman Seratt seconded. The voice vote was 5/0/0.

Mr. Young read the ordinance in its entirety.

Alderwoman Watson made the motion to approve. Alderwoman Seratt seconded.

In discussion, Mr. Miner and Mr. Epley explained why it was necessary to rescind the ordinance. Mr., Miner said the ordinance was defective, in that it held a faulty land description, and part of the land had not been approved by the Planning Commission, and shouldn’t have been included. Mr. Miner called Municipal League and talked to Bill Fleming. He suggested that the cleanest way to take care of this problem was to rescind. Mr. Epley said that the Council should stop work on Ordinance #1736, which is also erroneous, and he has an ordinance today with the right descriptions on it.

The roll call vote on the first reading was 5/0/0.

 

Alderwoman Seratt made the motion to suspend the rules and place Ordinance #1739 on its second reading by title only. Alderwoman Watson seconded. By roll call, all were in favor, 5/0/0.

Mr. Young read the ordinance by title only.

Alderwoman Seratt made the motion to approve. Alderwoman Watson seconded. By roll call, it passed, 5/0/0.

 

Alderwoman Seratt made the motion to further suspend the rules and place Ordinance #1739 on its third and final reading by title only. Alderwoman Watson seconded. By roll call, the vote was 5/0/0.

Mr. Young read the ordinance by title only.

Alderwoman Seratt made the motion to approve.  Alderwoman Watson seconded.  By roll call the ordinance passed on its third reading. 5/0/0.

Alderwoman Seratt made the motion to read the emergency clause.

Alderwoman Watson seconded. By roll call, the vote was 5/0/0.

Mr. Young read the emergence clause.

Alderwoman Seratt made the motion to approve. Alderwoman Watson

seconded. All were in favor, 5/0/0.

 

2. The Third Reading of Ordinance #1736:

Ordinance #1736 was the ordinance that should have corrected the description problem in Ordinance #1732. It was found that ordinance #1736 also had a faulty description and that it should fail. Alderwoman Seratt made the motion to place Ordinance #1736 on its third and final reading. Alderwoman Watson seconded. The vote to read was 0/5/0. and the ordinance failed.

3. Ordinance #1740, Petition to Re-Zone A Part of Block 179, R&A Survey in the City of Eureka Springs, Ar., From R-i Victorian Residential to C-1 Victorian Commercial:

Alderwoman Seratt made the motion to place Ordinance #1740 on its first reading in its entirety. Alderwoman seconded. All were in favor, 5/0/0. Mr. Young read the ordinance in its entirety.

Alderwoman Seratt made the: motion to approve. Alderwoman Watson seconded.

In discussion, Alderman Jeffrey asked if we can go ahead and read it since it hasn’t gone through an agenda meeting. Mr. Miner assured him that the Council can, and that it is expedient, since the whole thing has already been discussed.

Mr. Rubley said since the description was not right, was the map correct, and was told that yes, the color-coded map that Mr. Epley showed them was correct.

The roll call vote on the first reading was 5/0/0.

 

Alderwoman Watson made the motion to suspend the rules and place Ordinance #1740 on its second reading by title only. The motion died for want of a second.

Mr. Epley suggested that Ordinance #1733 and Ordinance #1740 be voted on at the same time, because it people were going to do referendum petitions on them, at least it wouldn’t cost the City as much.

 

4.. Ordinance #1733, a Petition to Vacate a part of First Street, Mr. Wilson and Mr. Smith:

Alderwoman Watson made the motion to postpone the reading until the next regular Council Meeting, which will be December 10th, 1996. Alderman Rubley seconded. All were in favor, 5/0/0.

 

5.      Resolution #438, to Allow the Parks and Recreation Commission to

                                                             Accept Grant money:

Alderman Rubley made the motion to read Resolution #438. Alderwoman

Seratt seconded. All were in favor, 5/0/0.

Mr. Young read the resolution in its entirety.

Alderwoman Seratt made the motion to approve. Alderwoman Dickens

seconded. All were in favor, 5/0/0.

 

6.      Transit Department, Mr. Fargo:

Mr. Fargo, Director of Transit, asked that the schedule of hours for the trolleys, and trams, be approved. The hours will be: April through Memorial Day, 9-5 daily; from Memorial Day through Labor Day, 9-6 Sunday through Friday, and 9-9 Saturdays. Holiday hours would be 12-5 on Fridays, and 9-5 on Saturdays Alderwoman Seratt made the motion to go with the hours Mr. Fargo suggested. Alderwoman Watson seconded.   All were in favor, 5/0/0.

Mr. Fargo asked that the Green Route be changed to go up Magnetic Road to the Passion Play and back on Highway 62 to the trolley station. It will save about $18,000, which is figured by mileage, the miles a trolley travels in a season, because it will free up a trolley from the blue route to use as a spare for when they need an extra one. It was mentioned, also, that the red route will be reversed because the new trams will be on line, and that will take care of the people who want to get up on Spring St. The roll call vote was 4/1/0, with Alderman Rubley voting no.

 

7.    Ordinance #1714, the 911 Numbering:

Aiderwoman Seratt made the motion to place Ordinance #1714 on its third and final reading by title only. Alderwoman Dickens seconded. The vote to read was 5/0/0.

Mr. Miner said that the ordinance had been amended by adding Section 10. He felt that Section 10 would take care of the problem of an appeal to keep the existing house number, and gives the procedure an owner or agent would follow. He said that the Council should vote on the amendment before voting on the ordinance.

Alderwoman Seratt made the motion to amend the ordinance by adding Section 10, changing the existing Section 10 to Section 11, and changing Section 11 to Section 12, and to read Sections 10, 11, and 12. Alderwoman Dickens seconded. All were in lavor, 5/0/0.

Mr. Young read Sections 10 through 12.

Alderman Seratt made the motion to approve. Alderwoman Watson seconded. By roll call, the vote was 5/0/0.

 

The vote on the third reading of Ordinance #1714, by roll call was 5/0/0.

 

ADMINISTRATIVE ASSISTANT’S REPORT:

City Administrative Assistant, Don Young had no report.

 

DEPARTMENT REPORTS:

There were no department reports.

 

COMMISSION, COMMITTEE, AND AUTHORITY REPORTS:

1.    Auditorium Commission: Position 5 is vacant.

6.    Parking Authority: Position 2 is vacant.

 

The Mayor said there had been a complaint from some of the business people that restrooms were not open as late as the signs say they are. Officer Dale Grunwald said he would be glad to lock the restrooms a little later in the evening. She said she would speak with Chief Hyatt, and see what could be arranged to keep the restrooms open a bit later. If the businesses are going to stay open, those facilities need to be available for use.

The Mayor said also, that some of the Business owners might want to stay open later,on some of these weekends, even during inclement weather. People are not inclined to travel, so they get bored and they go shopping, and a few of those who are open have made some good sales on nights like those.

 

The Mayor also reminded people to vote in the run-off election on

November 26th. It they need a ride, they can call City Hall. There are

people available to take them to the polls.

The Mayor reminded everyone that the City offices will be closed on

 

Thursday and Friday for Thanksgiving, November 28th and 29th.

 

ANNOUNCEMENTS:

The next Agenda-Setting Meeting will be held on December 5th, 1996 at 7 p.m.

Friday, December 6th, a budget meeting will be held at 9 a.m.

Tuesday, December 10th, a Public Hearing on the vacation of a part of Summit St.

will be held at 8:45 a.m., followed by the regularly scheduled Council Meeting.
