SPECIAL COUNCIL MEETING

JANUARY 21, 1997

 

During the agenda meeting held January 21, 1997, Attorney John Casteel asked that a special meeting be held to set a date for a public hearing for the vacation of a piece of Summit Street that falls on the property of Jan Weber Porter. Mrs. Porter’s health has deteriorated drasticly, and she has a sale pending on the property. She wanted to get the transaction settled as soon as possible. The Council had passed a street vacation two doors up from her property the month before, and there were no objections, so he thought that, with the Council’s help, this could be done. The Clerk had called the media and told them that it was possible that the Council might call a special meeting for this purpose. The Council agreed to call a special meeting.

 

The Mayor called the special Council Meeting to order at 7:10 p.m. Alderwoman Seratt and Alderman Jeffrey were out of town. John Casteel represented Jan Weber Porter with a Petition to Vacate the portion of Summit Street that her property is on. Mr. Casteel showed the Council the plat of where the property in question falls. This is another case in which the building or part of the building is built on a piece of Summit Street as it is platted, and the street is built in an area that was not platted as a street. All it does, by passing this vacation, is to clear the title of the property.

 

Alderman Christman made the motion to set a public hearing to deal with this issue. Alderwoman Watson seconded.

The Council had voted to hold all public hearings in the evenings in 1997 at their first meeting of the year. Alderman Freeland said that given the circumstances, it would serve the public and the circumstance to suspend the rules and do this hearing in the morning. Alderpersons Christman and Watson withdrew their motions.

 Alderman Christman made the motion to suspend the rules and set the Public Hearing at 8:45 a.m. before the Council Meeting on February 11th, 1997.

 The motion carried unanimously, 4/0/0.

 

The motion was made and seconded to adjourn the special Council meeting. 

The meeting was adjourned at 7:20 p.m.
