CITY COUNCIL
FIRST SPECIAL MEETING THURSDAY JUNE 23, 2005
Mayor Kathy Harrison called the special meeting of the Eureka Springs City Council to order at 8:07 p.m. Thursday, June 23, in the jury room of the Western District Carroll County Courthouse.
PRESENT: Mayor Kathy Harrison, Aldermen Robert “Butch” Berry, Beverly Blankenship, Aaron Falotico, Terry McClung, Rick Rojek, Lori Weaver, City Attorney Tim Weaver and City Clerk Mary Jean Sell.
Mayor Harrison said the purpose of the special meeting is to consider a proposal for a cash settlement of the lawsuit from Marilyn Still against the city.
Mr. Weaver distributed copies of the proposal from Richard R. Renner of Tate & Renner, Attorneys at Law, of Dover, Ohio.
Mr. Renner’s proposal: “Marilyn Still has authorized me to convey a settlement proposal. She can accept the sum of $120,000 (of which $24,000 would be paid to me, $10,000 would be paid to the National Whistleblower Legal Defense and Education Fund, and the remaining $86,000, would be paid to Marilyn Still). Mr. Tracy had previously offered $5,000. That means $115,000 from the City would settle this case.”
Mr. Weaver said the Council can: (1) acknowledge receipt of the proposal and choose not to act: (2) accept the proposal; (3) make a counter offer; and (4) reject the offer.
Mr. Rojek moved to reject Mr. Renner’s offer. Mr. Falotico seconded. Five voted aye. Mr. Berry voted no. He said he wanted to explore other options. Motion passed 5/1/0
Mr. Falotico moved to adjourn at 8:15 p.m. Mr. Rojek seconded. All voted aye. Motion passed 6/0/0
