SPECIAL MEETING MONDAY DECEMBER 19, 2005
Alderman Robert “Butch” Berry called the special meeting of the City Council to order at 6:30 p.m. in the third floor courtroom of the Western District Carroll County Courthouse.
PRESENT: Aldermen Robert “Butch” Berry, Beverly Blankenship, Penny Carroll, Rick Rojek, Terry McClung and City Clerk-Treasurer Mary Jean Sell. Mayor Kathy Harrison, Alderman Lori Weaver and City Attorney Tim Weaver were absent. Also present were Bob Rennels of Carroll County Newspapers, Bill King of The Lovely County Citizen and several members of the public.
The meeting was called by Alderman Berry, McClung and Carroll to discuss the dismissal of the Latimer Suit.
Ms. Carroll said she is concerned about the city being in great financial danger. She said the city will have to pay the legal fees for both sides in the lawsuit if the petitions to dismiss the appeal of the referendum petition regarding the Latimer case are not filed soon.
Ms. Blankenship said she had talked with attorney Kent Crow. Mayor Harrison had hand delivered her letter requesting the dismissal be filed and the petitions to do so.
Ms. Sell said she had talked with Mr. Crow this afternoon and had written a letter to him asking to dismiss the petition on her behalf. She faxed a copy to his office and mailed a copy.
Ms. Carroll recommended shutting off of the mayor’s budget and closing her department until the court actions are completed. She said she would go to Mr. Crow’s office and watch him sign the petitions and put them in the mail.
Mr. Berry said the paperwork is in process. He did not want to be reactionary. He suggested waiting until Dec. 29 to see if the paperwork is filed.
Mr. McClung moved to have a special meeting Friday, Dec. 30, at 2 p.m. Mr. Rojek seconded.
Ms. Carroll said she wanted concrete proof that the petitions had been filed.
On the motion for the special meeting, all voted aye. Motion passed 4/0/0
Ms. Carroll moved to request Ms. Sell to request from Mr. Crow that he provide signed copies of the dismissal petitions, his cover letter and a return receipt for certified mail as proof that he has sent the petitions for filing by Dec. 30. Mr. Rojek seconded. All voted aye. Motion passed 4/0/0
ADJOURNMENT: Ms. Carroll moved to adjourn at 7 p.m. Mr. Rojek seconded. All voted aye.
