SPECIAL MEETING TUESDAY AUGUST 1, 2006

Mayor Kathy Harrison called the special meeting of the Eureka Springs City Council to order at 5:30 p.m. in the jury room of the Western District Carroll County Courthouse.

PRESENT: Mayor Kathy Harrison, Aldermen Robert “Butch” Berry, Penny Carroll, Rick Rojek, Lori Weaver, City Attorney Tim Weaver and City Clerk-Treasurer Mary Jean Sell. Aldermen Beverly Blankenship and Terry McClung were absent.

Mayor Harrison said the purpose of the meeting is to discuss the hiring of legal counsel for the city’s defense in the Greenlee-Rogers/Sunday Market lawsuit. The Council had requested a special meeting to make a decision when the Arkansas Municipal League had responded to inquiries about representing/defending the city.

Mr. Weaver said the Municipal League has agreed to represent the city but it would not be responsible for any monetary coverage if damages are awarded. The League will charge its standard fee of $3,000 to take the case. Mr. Weaver will serve as local coordinator and will bill the city for his hours of work.

There was lengthy discussion of how many hours the case would take and how Mr. Weaver would bill his hours, either in general categories or by an itemized list.

Mr. Rojek moved to hire the Municipal League as the city’s defense team. Mr. Berry seconded.

Ms. Carroll moved to amend the motion to request itemized billing for Mr. Weaver’s work on the case. Mr. Rojek seconded. Three voted aye. Ms. Weaver recused herself from voting. Mayor Harrison voted aye to approve the amendment. Motion passed 4/0/1

ADJOURNMENT: Mr. Berry moved to adjourn at 5:58 p.m. Mr. Rojek seconded. All voted aye.
