CITY COUNCIL
SPECIAL MEETING MONDAY JANUARY 30, 2006
Mayor Kathy Harrison called the special meeting of the City Council to order at 5:05 p.m. Monday, Jan. 30, in the jury room of the Western District Carroll County Courthouse.
PRESENT: Mayor Kathy Harrison, Aldermen Robert “Butch” Berry, Beverly Blankenship, Penny Carroll, Terry McClung, Rick Rojek, Lori Weaver, City Attorney Tim Weaver, Bob Rennels of Carroll County Newspapers, Bill King of the Lovely County Citizen, Parks and Recreation Director Bruce Levine and City Clerk-Treasurer Mary Jean Sell.
The purpose for the special meeting was the approval of the 2006 budget for the City of Eureka Springs, AR.
Mr. McClung moved to place Ordinance #2016, an ordinance providing for and adopting budgets for the City of Eureka Springs for the twelve month period beginning January 1, 2006, and ending December 31, 2006, on its first reading. Mr. Berry seconded. All voted aye. Motion passed 5/0/0 (Ms. Carroll had not arrived.)
Mayor Harrison read Ordinance 2016 aloud.
Mr. McClung moved to approve Ordinance 2016 on its first reading. Mr. Rojek seconded.
Mayor Harrison said the general fund appropriation total did not include $24,098 for the cemetery employee’s salary. She said the $10,000 allocation to her office for legal services fund was an inadequate amount because it would not support the day-to- day expenses of prosecution of cases in district court after the $7,000 payment to Municipal League and the potential use of a Municipal League attorney.
Ms. Blankenship moved to amend the allocation to the Mayor’s Office for legal professional services to $20,000. Mr. Rojek seconded. All voted aye. Motion passed 5/0/0
Ms. Blankenship moved to amend the General Fund Appropriations total by adding $24,098 to cover the cemetery employee’s salary. Mr. Rojek seconded. All voted aye. Motion passed 5/0/0
Mr. McClung called the question to stop the discussion. Mr. Berry seconded. Mr. McClung, Mr. Berry and Mr. Rojek voted aye. Ms. Blankenship, Ms. Carroll and Ms. Weaver voted no. Motion failed 3/3/0.
There was additional discussion regarding the city’s support of the City Auditorium operation and maintenance, the Planer Hill parking lot development and the Saving America’s Treasures (SAT) loan payment.
On the motion to approve Ordinance 2016 on its first reading, as amended, all voted aye. Motion passed 6/0/0 (Ms. Carroll arrived at 5:25 p.m.)

Mr. McClung moved to suspend the rules and place Ordinance 2016 on its second reading by title only. Mr. Rojek seconded. By roll call, all voted aye. Motion passed 6/0/0
Mayor Harrison read the title of the ordinance aloud.
Ms. Blankenship moved to approve the second reading of Ordinance 2016 by title only. Mr. Rojek seconded. All voted aye. Motion passed 6/0/0
Ms. Blankenship moved to suspend the rules and place Ordinance 2016 on its third reading by title only. Mr. Berry seconded. By roll call, all voted aye. Motion passed 6/0/0
Mayor Harrison read the title of the ordinance aloud.
Ms. Blankenship moved to approve the third reading of Ordinance 2016 by title only. Mr. Rojek seconded. All voted aye. Motion passed 6/0/0
Mr. McClung moved to read the emergency clause. Ms. Blankenship seconded. All voted aye. Motion passed 6/0/0
Mayor Harrison read the emergency clause aloud.
