CITY COUNCIL
Mayor Dani Joy called the regular meeting of the Eureka Springs City Council to order at 6 p.m. Monday, July 28, 2008, in the jury room on the second floor of the Western District Carroll County Courthouse.
PRESENT: Mayor Dani D. Joy, Aldermen Patrick Brammer, Eric Scheunemann, Joyce Zeller, Finance Director Yvonne Kline and City Clerk-Treasurer Mary Jean Sell CMC. Aldermen Rae Hahn and Kathy Harrison were absent. City Attorney Tim Weaver arrived at 6:40 p.m.
Mayor Joy read aloud a statement listing some of the accomplishments of her first year and a half in office and her goals for the remainder of her term.

Mr. Brammer moved to approve the agenda. Mr. Scheunemann seconded.
Mr. Scheunemann moved to place Item #7 of New Business, discussion of Carroll County Solid Waste collection rates, as the first item of discussion. Mr. Brammer seconded. All voted aye. Motion passed 4/0/0
Mayor Joy said New Business Item #1, discussion of ordinance requiring convicted offenders to pay transportation fuel fee, has been withdrawn.
Ms. Zeller moved to table New Business Items #3, discussion of proposal for impact fees; #5, resolution for engineering study of Black Bass Dam; and #4, discussion of ordinance amending Municipal Code regarding speed bumps/humps to the next regular meeting, Aug. 11. Mr. Brammer seconded. All voted aye. Motion passed 4/0/0
Ms. Zeller moved to permanently remove New Business Item #2, discussion of regulations for musicians, artists in Basin Park, from the agenda. Mr. Brammer seconded. Ms. Zeller and Mr. Brammer voted aye. Mr. Scheunemann voted no. Motion failed 2/1/0

Aug. 11. Mr. Brammer seconded. All voted aye. Motion passed 4/0/0

June 23 – Mr. Brammer moved to approve the minutes of the regular City Council meeting of June 23, 2008. Ms. Zeller seconded. Mr. Brammer, Ms. Zeller and Mayor Joy voted aye. Mr. Scheunemann voted no. Motion failed 3/1/0
July 14 – Mr. Scheunemann moved to approve the minutes of the regular City Council meeting of July 14, 2008. Mr. Brammer seconded.
Mr. Scheunemann asked that his name be removed from New Business Item #1 on Page 3.
On the motion to approve the minutes of July 14 as amended, all voted aye. Motion passed 4/0/0.

NEW BUSINESS:
1. Discussion of Carroll County Solid Waste collection rates (Mayor Joy)
Phil Jackson, Executive Director of Carroll County Solid Waste Authority, made a
presentation of information regarding increases in costs for waste tipping, fuel, maintenance, insurance, etc. to operate the Authority as a preliminary to asking for a rate increase for solid waste pick up service in the City of Eureka Springs. The new rate is a 10.9 percent increase across the board, with residential rates going up $1.24 per month to $12.58. Commercial rates vary depending on the schedule of services.
Ms. Zeller moved to table any action on the request until the next regular meeting, Aug. 11. Mr. Scheunemann seconded. All voted aye. Motion passed 4/0/0
Alvin Byrd passed on a suggestion from Alicia Scheunemann to create a playground on Water Street.
Ms. Zeller moved to table New Business Item #6, discussion of 2007 budget clean-up ordinance, to the next regular meeting Aug. 11. Mr. Brammer seconded. All voted aye. Motion passed 4/0/0

Mayor Joy said she is nominating Robert “Butch” Berry to Position 1 on the Planning Commission/Board of Zoning Adjustment.
