CITY COUNCIL
Mayor Dani Joy called the regular meeting of the Eureka Springs City Council to order at 6 p.m. Monday, March 23, 2009, in the jury room on the second floor of the Western District Carroll County Courthouse.
PRESENT: Mayor Dani D. Joy, Aldermen Robert “Butch” Berry, Beverly Blankenship, Patrick Brammer, James DeVito, Rob Wagner, Joyce Zeller, City Attorney Tim Weaver, Mayor’s Assistant Diane Wilkerson and City Clerk-Treasurer Mary Jean Sell CMC.
PLEDGE OF ALLEGIANCE TO THE FLAG:
Mayor Joy led the Pledge of Allegiance to the Flag.
APPROVAL OF THE
AGENDA:
Mr. Brammer moved to approve the agenda. Mr. Wagner seconded.
Mr. DeVito asked to have a resolution supporting the Domestic Partnership Registry (DPR) included as New Business Item #2.
On the amended agenda, all voted aye. Motion passed 6/0/0
APPROVAL OF THE MINUTES: March 9, 2009
Mr. DeVito moved to approve the minutes of the regular meeting of Monday, March 9, 2009. Mr. Berry seconded.
Ms. Blankenship noted several changes.
On the motion to approve the amended minutes, all voted aye. Motion passed 6/0/0
COMMISSION,
COMMITTEE, AUTHORITY REPORTS AND VACANCIES:
Planning—Position 2 - expires 1/1/11 Position 7 – expires 1/1/11
HDC – Position 5 – expires 11/30/11 Mayor Joy nominated Greg Moon.
Cemetery – Position 2 expires 2/15/12
PUBLIC COMMENTS:
Seventeen persons spoke in support of the Artery on First St. They feel like it is an asset to the city, a tourist attraction, an opportunity for artists to be creative on a large scale. They do not want the artistic work censored or controlled by the Council or an art commission.
OLD BUSINESS:
1.
Discussion of the Artery on First Street
Mr. DeVito moved to open discussion. Mr. Wagner seconded.
Charlotte Buchanan, founder of the Artery, and James Yale, her business partner and
husband, spoke on the history and purpose of the Artery. She said she has added the Masters Apprentice Preservation Program within the National Heritage Program for young artists. She is planning to install new panels with a new theme this summer.
Mr. DeVito said there has never been a contract, resolution or ordinance between Ms. Buchanan and the City for use of the city-owned property.

Mr. DeVito moved to ask the city attorney to begin drawing a contract for the use of the property with the help of Ms. Buchanan and Mr. Yale. Mr. Wagner seconded. All voted aye. Motion passed 6/0/0
Ms. Zeller moved that contingent upon signing of an approved contract that Ms. Buchanan will continue as director of the Artery. Mr. DeVito seconded. All voted aye. Motion passed 6/0/0
Mr. DeVito moved at 8 p.m. to take a ten minute break. Mr. Wagner seconded. Meeting resumed at 8:10 pm.
NEW BUSINESS:
1. Discussion
of sidewalks
Mayor Joy said the Sidewalk Committee has met, but is not ready to make a presentation
this evening.
Mr. Brammer moved to postpone the discussion to the regular meeting of Monday, April 13. Mr. DeVito seconded. All voted aye. Motion passed 6/0/0
2. Discussion of a resolution in support of
the Domestic Partnership Registry
(DPR).
Mr. Wagner moved to open the discussion. Ms. Zeller seconded.
Mr. DeVito suggested writing a resolution supporting the DPR so Mayor Joy would have it to take with her to meet with the Legislative Committee in Little Rock on Friday. He suggested “we the undersigned members of the Eureka Springs City Council support the DPR of Eureka Springs.”
Mr. Brammer moved at 8:16 p.m. to take a short recess to give Mr. Weaver and Ms. Sell time to write the resolution. Mr. Wagner seconded. The meeting resumed at 8:35 p.m.
Mr. Brammer moved to adopt and read Resolution No. 558. Mr. DeVito seconded. There was no time for discussion. Five voted aye. Ms. Blankenship voted no. Motion passed 5/1/0
Ms. Sell read Resolution 558 aloud.
ADJOURNMENT:
Mr. Brammer moved to adjourn at 8:40 p.m. Mr. DeVito seconded. All voted aye. Motion passed 6/0/0
