CITY COUNCIL
Mayor Dani Joy called the regular meeting of the Eureka Springs City Council to order at 6 p.m. Monday, Aug. 10, 2009, in the jury room on the second floor of the Western District Carroll County Courthouse.
PRESENT: Mayor Dani D. Joy, Aldermen Robert “Butch” Berry, Rob Wagner, Joyce Zeller, City Attorney Tim Weaver, Finance Director Yvonne Kline and City Clerk-Treasurer Mary Jean Sell CMC. Alderman Patrick Brammer arrived after the approval of the agenda. Alderman Beverly Blankenship and James DeVito were absent.
PLEDGE OF ALLEGIANCE TO THE FLAG:
Mayor Joy led the Pledge of Allegiance to the Flag.

Mr. Wagner moved to approve the agenda. Mr. Berry seconded.
Ms. Zeller asked to add a discussion of sidewalks as New Business Item #2. Mr. Wagner seconded. All voted aye. Motion passed 4/0/0

Police Chief Earl Hyatt reported the parking meters for the parking lots have been ordered, arrived and installed. He said he is getting positive feedback from visitors about the meters.
PUBLIC COMMENTS:
Louise Mesa, 151 Spring St., asked for repairs to the sidewalk in front of her
building. She said water is coming through the stones in the sidewalk and running into her basement. She has 192 feet of aggregate sidewalk and would like to replace it with aggregate. She wants to get the sidewalk fixed.

1. Discussion
of mid-year budget adjustments
Mr. Berry moved to open discussion. Mr. Brammer seconded.

Mr. Brammer moved to place Ordinance 2107 regarding mid-year budget
adjustments on its first reading, Mr. Wagner seconded. All voted aye. Motion
passed 4/00
Ms. Sell read Ordinance 2107 aloud.
Mr. Brammer moved to approve Ordinance 2107. Mr. Wagner seconded. All
voted aye. Motion passed 4/0/0
Mr. Brammer moved to suspend the rules and place Ordinance 2107 on its
second reading by title only. Mr. Wagner seconded. By roll call, three voted
aye. Mr. Berry voted no. Mayor Joy voted aye to allow the reading. Motion
passed 4/1/0
Ms. Sell read the title of Ordinance 2107 aloud.
Mr. Brammer moved to approve Ordinance 2107 on its second reading. Mr.
Wagner seconded. Three voted aye. Mr. Berry voted no. Mayor Joy voted aye to
approve the second reading. Motion passed 4/1/0
2. Discussion
of sidewalks.
Mr. Brammer moved to open the discussion. Ms. Zeller seconded. All voted
aye. Motion
passed 4/0/0
Ms. Zeller said work needs to move
forward on repairing sidewalks throughout the city. A proposal to amend the
sidewalk ordinance was presented to the Council from the HDC (Historic District
Commission) several months ago and referred on to the Planning Commission. She
said it is time for the ordinance to come back to the Council table.
Mr. Wagner moved to have sidewalks
as a discussion item on the agenda for the regular meeting of Aug. 24 and to
have an ordinance ready by the regular meeting of Sept. 14. Mr. Brammer
seconded. All voted aye. Motion passed 4/0/0
