CITY OF EUREKA SPRINGS

CITY COUNCIL

SPECIAL MEETING                                TUESDAY                NOVEMBER 30, 2004

Mayor Kathy Harrison called the special City Council meeting to order at 6:35 p.m. Nov. 30 in the jury room of the Western District Carroll County Courthouse.

PRESENT: Mayor Kathy Harrison, Aldermen Robert “Butch” Berry, Aaron Falotico, Karen Lindblad, Bill Ott and Earl “Bud” Umland, City Attorney Tim Weaver, Mayor’s Assistant Brenda Spencer, Aldermen-elect Beverly Blankenship, Rick Rojek, Terry McClung, Lori Weaver, City Advertising and Promotion Commission (CAPC) Marketing Director Lynn Berry and City Clerk Mary Jean Sell.

The purpose of the meeting was discussion of the ordinance regarding the definition of who would collect the CAPC tax.

Ms. Lindblad said the meeting was illegal and should not continue because the steps for calling a special meeting as outlined in the Municipal Code had not been properly followed.

Bill King, publisher of The Lovely County Citizen newspaper asked if the rules could be suspended and the meeting held since all of the council members, the city attorney and representatives of the press were present.

Mr. Ott said he did not want any action or vote taken during the meeting thrown out later on a technicality. He asked for the discussion to be put on the agenda for the next council meeting.

Mr. Berry moved to adjourn at 6:50 p.m. Mr. Falotico seconded.
