ORDINANCE NO. 1809
AN ORDINANCE OF THE CITY OF EUREKA SPRINGS,
ARKANSAS, WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING AS RELATES TO THE PURCHASE
OF A CERTAIN MOTOR VEHICLE; AND DECLARING
AN EMERGENCY
WHEREAS, the City of Eureka Springs, Arkansas, has for sometime desired to purchase a utility motor vehicle for service with the City under supervision of the City Fire Department; and,
WHEREAS, that after some investigation the City finds that the purchase of a new vehicle to be excessive, and believes the needs of the City can well and best be served by the purchase of a used vehicle in good condition; and,
WHEREAS, the City has done extensive research and investigation and has located a used vehicle, in good and usable condition, with a used vehicle dealer who is willing to take, in partial trade, an existing vehicle owned by the City, at a value the City believes fair and reasonable; and,
WHEREAS, attempts to advertise for a used vehicle have proved not to be feasible or practical due to the wide variance in vehicles, the equipment thereof, the condition thereof and the availability thereof, and by reason thereof the requirements of competitive bidding in this exceptional situation should be waived; and,
WHEREAS, in order to purchase the vehicle selected by the City, it is necessary to declare an emergency for the reason that it is believed that said vehicle may not be available for purchase at the time a non-emergency ordinance would go into effect.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS, as follows:
SECTION ONE: That pursuant to the provisions of Section 3.04.02 of the Eureka Springs Municipal Code of the Council of said City does hereby waive the requirements of competitive bidding for the following purchase and expenditure, to wit:
Vehicle to be purchased: 1977 Chevrolet Tahoe, white, 4-dr., 4-wheel dr.,
with approximately 30,000 miles
From: David Davis Used Auto, Harrison, Arkansas
Purchase price: $24,000.00, less $2,500.00 to be allowed for
Trade-in of Chevrolet Blazer owned by City
(approx. 1986, for a net cash requirement of
$21,500.00)
Terms: cash on taking possession
It being found by the City Council that this is an exceptional situation where the procedure for competitive bidding is deemed not feasible or practical.
SECTION TWO: Than an emergency is hereby declared and found to exist in that the City must act expediently to purchase the vehicle in question or the same may not be available, and as such this ordinance shall go into full force and effect immediately upon its passage.
IT IS SO PASSED AND ORDAINED THIS 15TH DAY OF APRIL, 1999.
