ORDINANCE NO. 1997

AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF EUREKA SPRINGS TO INCREASE THE BID LIMIT FOR MUNICIPAL PURCHASES AND CONTRACTS

WHEREAS, the City Council of City of Eureka Springs is authorized by the Municipal Code to regulate the bid limit for municipal purchases and contracts, and

WHEREAS, the current limitation imposed by the Arkansas State Legislature has been increased to Twenty Thousand Dollars, ($20.000.00).

NOW THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS:

Section 1. That in accordance with the Act 1435 of 2005 the bid limit requirement for Purchases authorized without bidding is hereby raised from Ten Thousand Dollars ($10,000.00) to Twenty Thousand Dollars ($20,000.00)

Section 2. That Sections 3.04.01 and 3.04.02 are amended to remove the amount of Ten Thousand Dollars ($10,000.00) at each location it appears in these sections and to replace it with the amount of Twenty Thousand Dollars ($20,000.00).

Section 3. That all ordinances and parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.

Section 4. If any part of this ordinance is found unenforceable for any reason whatsoever by a court of competent jurisdiction, it shall not affect the remaining parts thereof.
