ORDINANCE NO. 1998

AN ORDINANCE OF THE CITY OF EUREKA SPRINGS, ARKANSAS,

WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING AS

RELATES TO THE PURCHASE OF A FIRE SAFETY HOUSE AND DECLARING AN EMERGENCY

WHEREAS, the City of Eureka Springs, Arkansas, is desiring to purchase a new Fire Safety House to be used for the purpose of education of life safety and protection of property by the City of Eureka Springs Fire Department; and

WHEREAS, after research and inquiry, the City of Eureka Springs Fire Chief has determined that the Mobile Concepts by Scotty Fire Safety House is suited to the needs of Eureka Springs and that no other Fire Safety House is a reasonably suitable alternative; and

WHEREAS, the cost of the Fire Safety House is approximately $36,083.00, which exceeds the $10,000.00 limit for purchase without competitive bidding; and

WHEREAS, the City Council has determined that exceptional circumstances exist which render the competitive bidding process to not be practical or feasible; and

WHEREAS, a state of emergency exists because the Fire Safety House will provide education of life safety and protection of property not now available; NOW, THEREFORE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS:

1. That pursuant to the provisions of Section 2-222(d) of the Eureka Springs Municipal Code, the City Council does hereby waive the requirements of competitive bidding for the purchase of the Fire Safety House from Mobile Concepts by Scotty.

2. That all ordinances or resolutions, and parts thereof, in conflict herewith are hereby repealed to the extent of such conflict.

3. That each of the provisions of this ordinance are severable and the decision of any court having jurisdiction as to the validity of any provision shall not effect the remaining provisions.

EMERGENCY CLAUSE

That a state of emergency exists due to the need for immediate purchase of this Fire Safety House due to a one year limit on the availability of FEMA grant funds and therefore, this ordinance shall go into full effect immediately upon its passage.
