AN ORDINANCE DESIGNATING A LOADING ZONE ON SPRING STREET AT PENDERGRASS CORNER PER THE MUNICIPAL CODE OF THE CITY OF EUREKA SPRINGS WITH EMERGENCY CLAUSE

WHEREAS, the City Council of City of Eureka Springs is authorized by the Municipal Code to regulate the areas used as loading zones along city streets, and

WHEREAS, there is a need to establish a loading zone on Pendergrass Corner on Spring Street to serve the local businesses that does not interfere with the flow of traffic on Spring Street.

NOW THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS:

Section 1. That a loading zone shall be established on the left hand side of the street when traveling down hill beginning ten feet uphill from the center of the corner and running to the center of the corner and thence continuing sixty feet from the corner downhill toward main street.

Section 2. That parking in the loading zone shall be limited to vehicles parking parallel to the sixty feet side of the zone for loading and unloading only.

Section 3. That the Public Works Department is hereby directed to mark the loading zone established by this ordinance.

Section 4. That all ordinances and parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.

Section 5. If any part of this ordinance is found unenforceable for any reason whatsoever by a court of competent jurisdiction, in shall not affect the remaining parts thereof.

Section 6. EMERGENCY CLAUSE - That for the efficient operation of the City of Eureka Springs and for the public’s safety and welfare, an emergency is declared to exist. And this ordinance shall be in full force and effect from and after the date of its passage.
