AN ORDINANCE AMMENDING THE 2005 ADOPTED BUDGET OF THE CITY OF EUREKA
SPRINGS, ARKANSAS: APPROPRIATING MONEY
FOR THE SPECIAL ELECTION ON NOVEMBER 8, 2005 AND DECLARING AN EMERGENCY
WHEREAS, the City Council of the City of Eureka Springs,
Arkansas, has made a comprehensive study and review of the proposing budget and
WHEREAS, the adopted 2005 Budget did not contain
funds for a special election and
WHEREAS, in the opinion of the City Council, the
adopted 2005 Budget accurately, as possible, reflects, the City’s anticipated
revenues and expenditures for the 2005 calendar year, and;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS, THAT;
1. This ordinance shall be known as the Special
Election Amendment to the Budget Ordinance for the City of Eureka Springs,
Arkansas, for the year of 2005. All
revenues and appropriations are based on estimated revenues; and all estimates
are subject to change during the budgetary period.
2. That the amount of the expenditure to fund
the special election is $2,748.11 and insomuch as it was not a budgeted item,
the 2005 budget is hereby amended to reflect the cost of the November 8, 2005,
Special Election. The transfer of the
above stated sum from the General Fund to pay for the said election is hereby
approved by the City Council of the City of Eureka Springs, Arkansas; and it is
hereby authorized and appropriated for the purposes set forth.
3. That all ordinances or resolutions, and parts
thereof, in conflict herewith are hereby repealed to the extent of such
conflict.
4. That each of the provisions of this ordinance are severable and the decision of any court having jurisdiction as to the validity of any provision shall not effect the remaining provisions.
EMERGENCY
CLAUSE
That a state of
emergency exists due to the need for a Special Election and therefore, this
ordinance shall go into full effect immediately upon its passage.
