AN ORDINANCE VACATING PORTIONS OF THE DEDICATED (OR UNDEDICATED) STREET K NOWN AS SOUTH NEBO STREET

WHEREAS, the City Council of Eureka Springs, Arkansas, has reviewed the petition of the adjoining landowners to vacate a portion of the street as defined by the following legal description:

THAT PART OF SOUTH NEBO STREET LYING NORTHEASTERLY OF BLOCK 166 AND BLOCK 167, AND LYING SOUTH OF WHEELER STREET AT ITS PRESENT LOCATION, RILEY AND ARMSTRONG SURVEY TO THE CITY OF EUREKA SPRINGS, CARROLL COUNTY, ARKANSAS.

WHEREAS, A.C.A. 14-54-104(2) allows cities of the first class to vacate streets that are not required for corporate purposes and A.C.A. 14-301 Subchapter 3 – VACATING STREETS AND ALLEYS FOR PUBLIC USE GENERALLY.

NOW THEREFOR BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS, THAT:

Section 1: That the portion of the Dedicated (undedicated) street described above is hereby vacated and title to it is hereby vested in fee simple in the adjoining landowners with each landowner taking to the center line of the said property for the sum of $400.00
