ORDINANCE NO. #2012

AN ORDINANCE AUTHORIZING THE TRADING OF CERTAIN REAL ESTATE LOCATED ON A PART OF HINES STREET

WHEREAS, the City Council of Eureka Springs, Arkansas, has been petitioned to trade title to certain Real Estate, and

WHEREAS, there is a physical encroachment of a house owned by petitioner on to city property.

NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS, THAT:

Section 1. That title to the section herein described below and belonging now to the City shall be traded for the title to the section herein described below and belonging now to the petitioner. That the Office of Mayor is hereby authorized to sign all documents needed to effectuate this transfer.

City to Gentry: A part of Hines Street, between Blocks 93 and 94, Riley and

Armstrong Survey to the City of Eureka Springs, Arkansas, and being more

particularly described as follows: Commence at the most westerly corner of

Lot 28 of said Block 94, thence S 56º12’13”E 21.46 feet to the point of

beginning; thence S 56º12’24”E 26.10 feet, thence S 62º59’52”E 18.99

feet, thence S 22º06’06”W 5.58 feet, thence N 67º23’18”W 12.74 feet,

thence S 22º36’42”W 3.96 feet, thence N 67º22’44”W 9.93 feet,

thence N 22º36’42”E 3.97 feet, thence N 67º24’18”W 11.57 feet,

thence N 22º06’06”E 4.53 feet, thence N 67º23’18”W 10.24 feet,

thence N 22º06’06”E 7.56 feet to the point of beginning,

containing 356.6 square feet.

Gentry to City: A part of Lot 13, Block 93, Riley and Armstrong Survey

to the City of Eureka Springs, Arkansas, and being more particularly

described as follows: Commence at the most easterly corner of said lot

for the point of beginning; thence N 89º18’44”W 33.08 feet, thence

N 0º41’16”E 21.57 feet, thence S 56º12’26”E 39.48 feet to the point

of beginning, containing 356.6 square feet.

Section 2. That provisions of this ordinance are hereby declared to be separable and if any provision shall for any reason be held illegal or invalid, such holding shall not affect the validity of the remainder of this ordinance.

Section 3. All ordinances and resolutions and parts thereof, in conflict herewith are hereby repealed to the extent of such conflict.
