AN ORDINANCE TO REZONE PROPERTY FROM MOBILE HOME PARK (MHP) TO C-2 CONTEMPORARY COMMERCIAL

 

WHEREAS, the City Council of the City of Eureka Springs, Arkansas, has determined that it is in the best interest of the City to rezone the following described property from Mobile Home Park (MHP) to C-2, Contemporary Commercial: Part of the Northwest Quarter of the Northwest Quarter (NW ¼ NW ¼), Section 23, Township 20 North, Range 26 West, described as follows: Commencing at the Northwest corner of said forty, run East 40 rods for place of beginning; thence South 23 rods and 12½ links; thence East 200 feet; thence North 23 rods and 12½ links; thence West 200 feet to place of beginning; containing 1.78 acres, more or less all in the City of Eureka Springs, Carroll County, Arkansas.

 

NOW, THEREFORE, BE IT HEREBY ORDAINED:

 

            Section 1. That the zoning on the property described above, formerly owned by Blanche Cummins, now owned by The Donald P. Briggs Trust, and located along U.S. Highway 62 at an address known as 3062 E. Van Buren, Eureka Springs, Arkansas, should be changed from Mobile Home Park (MHP) to C-2 Contemporary Commercial.

 

            Section 2. Conflicts: All ordinances or resolutions, and parts thereof, in conflict herewith are hereby repealed to the extent of such conflict.

 

            Section 3. Severability: In the event any one or more of the provisions contained in this ordinance shall for any reason be held by a court of law to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect the remaining provisions of this ordinance, and this ordinance shall be construed as if such invalid, illegal or unenforceable provision or provisions had never been contained herein.
