ORDINANCE NO. 2026
AN ORDINANCE AMENDING SECTION 11.20.21 OF THE EUREKA SPRINGS MUNICIPAL CODE, ADOPTING THE 1995 ARKANSAS GAS CODE
AND PROVIDING FOR
AN EMERGENCY
WHEREAS, the City Council of the City of Eureka Springs, Arkansas, has determined it would be in the best interest and safety of the citizens of Eureka Springs to adopt a change in the Arkansas Gas Code 1995 edition, as adopted by Ordinance 1929, Oct. 12, 2003; and
WHEREAS, the adoption of the change will provide for greater safety of all Eureka Springs school children; and
WHEREAS, an emergency situation has been found to exist by the Building Official of the City of Eureka Springs, Arkansas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS:
Section 1: That Section 103.2 of the Arkansas Gas Code, 1995 edition, be amended to read as follows: removing “Each school accredited by the Arkansas Department of Education” and adding All schools, K-12, within the corporate limits of the City of Eureka Springs, Arkansas shall have conducted an annual inspection of its gas piping and gas utilization equipment.”
Section 2. If any section or subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unenforceable for any reason whatsoever, it shall not affect the remaining portions of this ordinance.
Section 3. DECLARING AN EMERGENCY Because this ordinance has a direct affect on the safety of the school children and citizens of the City of Eureka Springs, an emergency is hereby declared to exist and this Ordinance shall be in full force and effect upon the date of its final passage and approval.
