ORDINANCE # 2028
AN ORDINANCE TO WAIVE THE BID FOR EXPENDITURES BY THE CAPC FOR CHRISTMAS LIGHT RENTAL AND DECLARING AN EMERGENCY.
WHEREAS, the City Council of the City of Eureka Springs,
Arkansas has authorized by Ordinance # 2025 the transfer of funds from the
General Fund to the City Advertising and Promotion Commission; and
WHEREAS, a limited number of companies provide this
service rendering the competitive bidding process to not be practical or
feasible; and
WHEREAS, the City Advertising and Promotion Executive
Director must sign a contract for services/rental agreement in a timely manner:
and
WHEREAS, an emergency for the preservation public safety
exists,
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EUREKA SPRINGS, THAT:
Section 1. This ordinance shall cause monies to be transferred to the City Advertising and Promotion account, in the amount of $35,088.95, as written in Section 5, of Ordinance #2025, a General Fund Account, called the Latimer Settlement.
Section 2. The City Council does hereby waive the requirements of competitive bidding, as it is not feasible or practical for this specific service, and enabling the City Advertising and Promotion Executive Director to initiate a contract with The Service Group, a company installing temporary Holiday Lights, for a period of 90 days.
Section 3. Emergency Clause: Since the Electrical Code must be followed and public safety must be preserved, as per Fire Marshall Jim Kelley’s attached letter, but not limited thereunto, the City Council declares an emergency exists and this Ordinance shall take effect and be in force from and after its passage and approval.
