ORDINANCE NO. 2045

AN ORDINANCE AMENDING CHAPTER 11.08 CONTRACTORS, SECTION 11.08.02 SURETY BOND OF THE EUREKA SPRINGS MUNICIPAL CODE.

FOR THE CITY OF EUREKA SPRINGS, ARKANSAS:

WHEREAS, the City Council of the City of Eureka Springs, AR, has determined that it is in the best interest of the City to amend Chapter 11.08, Section 11.08.02 of the Eureka Springs Municipal Code.

NOW THEREFORE, be it ordained by the City Council of the City of Eureka Springs, Arkansas, that:

Section 1. Section 11.08.02 Surety Bond of the Eureka Springs Municipal Code shall be amended to read as follows.

11.08.02 Surety Bond

All general contractors and all other contractors must deliver to the City a surety bond with a surety bonding company in the sum of no less than Ten Thousand Dollars ($10,000).

Section 2. All Ordinances and Resolutions, and parts thereof, in conflict with this Ordinance are hereby repealed to the extent of such conflict. In the event any one or more of the provisions contained in this Ordinance shall for any reason be held by a court of competent jurisdiction to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect the remaining provisions of this Ordinance, and this Ordinance shall be construed as if such invalid, illegal or unenforceable provision or provisions has never been contained herein.
