ORDINANCE NO. 2048

 

AN ORDINANCE AMENDING TITLE 8, CHAPTER 8.44, PARKING,

 OF THE EUREKA SPRINGS MUNICIPAL CODE, PERTAINING TO DESIGNATED PARKING AND LOADING ZONE AREAS

 

            WHEREAS, the Eureka Springs Police Department and the Transit Department have recommended that traffic flow and safety on Spring Street between Howell Street and Crescent Spring will improve by relocating on-street parking and a loading zone from the east side of the street to the west side; and

 

            WHEREAS, the relocation of on-street parking from the east side to the west side of Spring Street between Howell Street and Crescent Spring will not result in any loss of existing on-street parking places; and

 

WHEREAS, the Eureka Springs Police Department and the Transit Department also have recommended that the creation of a fifteen (15) foot loading zone on the west side of Spring Street at the junction with Pine Street will not interfere with traffic flow.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS, THAT:

 

Section 1.  That Section 8.44.16(E) is hereby amended in its entirety to read as follows:

 

E.  It shall be unlawful to park any vehicle within the following designated areas

     on Spring Street and/or the Boulevard in the city:

 

1.  On the east side of Spring Street between the junctions of German

     Alley and Hillside Avenue;

 

            2.  On the west side of Spring Street between Tulip Street and the six

one-hour free parking spaces established in Section  8.44(EE) of the   Eureka Springs Municipal Code EXCEPT FOR five (5) free parking places starting 15 (fifteen) feet from the northern edge of Tulip Street and extending north 100 feet;

                      

3.  One on the west side of Spring Street between Howell Street and Tulip

Street except for thirteen (13) free parking places starting 15 (fifteen) feet from the southern edge of Tulip Street and extending south;

                

4.  On the west side of Spring Street from the Presbyterian Church to the

     junction of King Street;

 

5.  On the east side of Spring Street from the junction of King Street to the

     junction of Crescent Avenue;

 

            6.  On the west side of Spring Street from the junction of Crescent Avenue

                 to the east edge of the Grotto Spring Reservation.

 

Section 2.  That Section 8.44(FF) is hereby repealed.

 

Section 3.   That Section 8.44 (LL) is hereby amended in its entirety to read as follows:

 

LL.  A loading zone is established on the west side of Spring Street starting at the

       southern edge of the last free parking space provided in Section 8.44(E)(3) of

       the Eureka Springs Municipal Code and extending 50 (fifty) feet south.

 

            Section 4. That Section 8.44(D)(18) is hereby amended in its entirety to read as follows:

 

                        18.  After crossing Owen Street, from the northern most curb of Owen

                               Street, the next 192 feet shall be designated as no parking with a red

       curb and the 15 (fifteen) feet immediately thereafter shall be

       designated as a loading zone with a yellow curb.

 

Section 5. All Ordinances or Resolutions, and parts thereof, in conflict with this Ordinance are hereby repealed to the extent of such conflict. The provisions of this Ordinance are severable and if any phrase, clause, sentence, paragraph or section shall be declared unconstitutional or invalid by the judgment or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections.
