ORDINANCE NO. 2074
AN ORDINANCE CALLING A SPECIAL ELECTION IN THE CITY OF EUREKA SPRINGS, ARKANSAS, ON THE QUESTION OF APPROVING OR REJECTING ORDINANCE NO. 2047 ENTITLED AN ORDINANCE AMENDING CHAPTER 2.60 HISTORIC DISTRICT COMMISSION OF THE CITY OF EUREKA SPRINGS, ARKANSAS MUNICIPAL CODE
WHEREAS, the citizens of the City of Eureka Springs, Arkansas, submitted a
referendum petition to the City Clerk on August 31, 2007, asking for an
election to approve or reject Ordinance 2047 entitled An Ordinance Amending
Chapter 2.60 Historic District Commission of the City of Eureka Springs,
Arkansas Municipal Code passed and approved by the City Council of Eureka
Springs, Arkansas, June 25, 2007; and
WHEREAS, on October 9, 2007, the City Clerk of the City of Eureka Springs,
Arkansas, certified a sufficient number of signatures on the petitions required
to set such a special election; and
WHEREAS, the City Council of the City of Eureka Springs, Arkansas, voted
November 26, 2007, to set a special election for Tuesday, May 20, 2008,
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Eureka Springs, Arkansas:
Section 1. That there be, and there is hereby called, a special election to be held on May 20, 2008, at which election there shall be submitted to the electors of the City, the question of approving or rejecting Ordinance 2047 entitled An Ordinance Amending Chapter 2.60 Historic District Commission of the City of Eureka Springs, Arkansas Municipal Code
Section 2. That the questions shall be placed on the ballot for the election in substantially the following form:
FOR An Ordinance Amending Chapter 2.60 Historic District Commission of the City of Eureka Springs, Arkansas Municipal Code
AGAINST An Ordinance Amending Chapter 2.60 Historic District Commission of the City of Eureka Springs, Arkansas Municipal Code
Section 3. That the election shall be held and conducted and the vote canvassed and the results declared under the law and in the manner now provided for municipal elections unless otherwise provided in the Authorizing Legislation and only qualified voters of the City shall have the right to vote at the election.
Section 4. That all ordinances and parts thereof in conflict herewith are hereby repealed to the extent of such conflict.
