ORDINANCE NO. 2091

AN ORDINANCE REGARDING DISPOSAL OF ANIMAL FECES

 WHEREAS the City Council of Eureka Springs, AR, has reviewed the need for the proper disposal of animal feces

 NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS, THAT:

 Section 1. It is unlawful for any person, firm or corporation to allow feces from animals owned by them to remain on either public or private property without permission of the property owner.

 Section 2. Any person, firm or corporation violating this section shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of Twenty-Five Dollars ($25.00) for the first offense and Fifty Dollars ($50.00) for a second or subsequent offense occurring within one (1) year from conviction of the previous offense, plus court costs.

 Section 3. That provisions of this ordinance are hereby declared to be separable and if any provision shall for any reason be held illegal or invalid, such holding shall not effect the validity of the remainder of this ordinance.

 Section 4. All ordinances and resolutions or parts thereof, in conflict herewith are hereby repealed to the extent of such conflict.
