ORDINANCE NO. 2105
AN ORDINANCE AMENDING SECTION 11.32 OF THE EUREKA SPRINGS MUNICIPAL CODE ADOPTING THE INTERNATIONAL FIRE CODE

WHEREAS, it has been determined by the Eureka Springs City Council that it would be in the best interests of the City to adopt the 2007 Arkansas Fire Prevention Code, that said code regulates and governs the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, material and devices, and from conditions hazardous to life or property in the occupancy of building and premises in the City, and
WHEREAS, the 2007 Arkansas Fire Prevention Code is based on the 2006  International Fire Code (IFC), International Building Code (IBC),  International Residential Code (IRC).

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, AR, THAT:

Section 1. That Section 11.32.01 of the Eureka Springs Municipal Code is amended to read as follows:
“Section 11.32.01 – That a certain document, three (3) copies of which are on file in the office of the City Clerk of Eureka Springs, being marked and designated as the 2007 Arkansas Fire Prevention Code, including Appendix Chapters B through G, is hereby adopted as the Code of the City of Eureka Springs for regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of building and premises in the City of Eureka Springs and providing for the issuance of permits for hazardous uses or operations; and each and all of the regulations, provisions, conditions and terms of the 2007 Arkansas Fire Prevention Code, published by the International Code Council (ICC), on file in the office of the City Clerk are hereby referred to, adopted and made party hereof as if fully set out in this ordinance. Nothing in this amendment shall be construed to revoke any portion of the International Building Code (IBC) as previously adopted.”

Section 2. That the following sections of the 2007 Fire Prevention Code are hereby revised in the following manner:
a.    In Section 11.32.02A insert ‚Äö√Ñ√∫city of Eureka Springs Fire Prevention Code.‚Äö√Ñ√π
b.    Amend Section 11.32.02B to read as follows: ‚Äö√Ñ√∫The codes and standards referenced in this code shall be those that are listed in Chapter 45 of Volume 1 and such codes and standards shall be considered part of the requirement of this code to the prescribed to the extent of such reference. In regard to the referenced NFPA codes and standards the most current editions shall apply. Where differences occur between the provisions of the code and the referenced codes and standards, the most stringent shall apply.‚Äö√Ñ√π
c.    Amend Section 11.32.02E to read as follows: "Where access to or within a structure or an area is restricted because of secured openings or where immediate access is necessary for life-saving or fire-fighting purposes or in sprinklered and alarmed buildings an approved key box in an approved accessible location shall be provided.  The key box shall be of an approved type and shall contain keys to gain access as required by the code official."
f. Section 11.32.02F to read as follows:  "Alarm, supervisory and trouble signals shall be distinctly different and shall be automatically transmitted to an approved central station, remote supervising station or proprietary supervising station as defined in NFPA 72."
g. Section 11.32.02 "An approved fire alarm system meeting the requirement of NFPA 72 shall be installed and connected to all new automatic sprinkler systems and shall communicate an audible and visual alarm throughout the entire building.  Such sprinkler water-flow alarm devices shall be activated by water flow equivalent to the flow of a single sprinkler of the smallest orifice size installed in the system.  Alarm devices shall also be provided on an exterior of the building in an approved location.  Actuation of the automatic sprinkler system shall actuate the building fire alarm system."  (Ord. Section 3. If any section, subsection, sentence, clause of phrase of this ordinance is, for any reason, held to be unenforceable for any reason whatsoever, it shall not affect the remaining portions of this ordinance.
