ORDINANCE NO. 2142

AN ORDINANCE CLARIFYING THE QUALIFYING LEGALLY NON-CONFORMING
MULTI-FAMILY DWELLINGS IN R-1 ZONING AS OF THE PASSING OF THIS ORDINANCE

WHEREAS, the City Council of Eureka Springs has determined that there needs
to be a list of Legally Non-Conforming Multi-Family Dwellings in R-1 for future proper
code and zoning enforcement;

NOW THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL
OF THE CITY OF EUREKA SPRINGS, ARKANSAS:

Section 1. The attached list of properties shall be henceforth be included as
Appendix C to Title 14 of the Eureka Springs Municipal Code Title

Section 2. Appendix C to Title 14 of the Eureka Springs Municipal Code
Title is hereby established as a complete list of properties with Legally Non-Conforming
Multi-Family Dwellings in R-1 at this time as a result of the previous passage of
Ordinance 1816 and operation of law.

Section 3. That should any of these properties lose their status by operation of
law in the future that property or properties shall be removed from Appendix C to Title
14 of the Eureka Springs Municipal Code.

Section 4. All ordinances and parts of ordinances in conflict with this
ordinance are hereby repealed to the extent of such conflict.
