ORDINANCE NO. 2123
AN ORDINANCE REGARDING FEEDING OF NON-DOMESTICATED DEER

WHEREAS the City Council of Eureka Springs, AR, has reviewed the need to prevent the feeding of non-domesticated deer,

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS, THAT:

Section 1.    It is unlawful for any person, firm or corporation to feed non-domesticated deer on either public or private property within the city limits of Eureka Springs, Arkansas.

Section 2.     Any person, firm or corporation violating this section shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of $100 for the first offense and $200 for a second or subsequent offense occurring within one (1) year from conviction of the previous offense, plus court costs.

Section 3.     That provisions of this ordinance are hereby declared to be separable and if any provision shall for any reason be held illegal or invalid, such holding shall not effect the validity of the remainder of this ordinance.

Section 4.     All ordinances and resolutions or parts thereof, in conflict herewith are hereby repealed to the extent of such conflict.
