ORDINANCE NO. 2100

AN ORDINANCE AMENDING CHAPTER 7.52, SIGNS, OF THE EUREKA SPRINGS, AR, MUNICIPAL CODE

WHEREAS, the Planning Commission of Eureka Springs, Arkansas, find it necessary to recommend amendments to the Municipal Code from time to time in order to ensure consistent application and enforcement of the code, and

WHEREAS, the Planning Commission recommends regulating signage in the City in the interest of public safety and to reduce visual pollution, and

WHEREAS, certain sections of the Eureka Springs Sign Ordinance, codified in Chapter 7.52 of the Eureka Springs, AR, Municipal Code have proven to be ambiguous and are in need of amendment in order to obtain these goals,

NOW THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, AR, THAT CHAPTER 7.52 OF THE EUREKA SPRINGS, AR, MUNICIPAL CODE REGARDING SIGN REGULATIONS BE AMENDED THUS:

Section 1. That Section 7.53.08(B) 6 shall be removed in its entirety.

Section 2. That Section 7.52.05(A) 4 is amended by removing the words “in R-1, R-2, C-1, C-3 (only allowed in C-2) except as allowed in 7.52.08.”

Section 3. That provisions of this ordinance are hereby declared to be separable and if any provision shall for any reason be held illegal or invalid, such holding shall not affect the validity of the remainder of this ordinance.

Section 4. All ordinances and resolutions or parts thereof, in conflict herewith are hereby repealed to the extent of such conflict.
